The Independent Hearing Officer (IHO) serves are the hearing officer for UC Berkeley's student conduct process and coordinates the hearing process for student cases of sexual violence and harassment. The incumbent is an individual contributor that manages sensitive communications, timelines, pre-hearing procedures, and procedures related to student conduct and safety.
Manage and coordinate Sexual Violence and Sexual Assault (SVSA) hearings, including:
Draft and disseminate official communication to parties regarding deadlines, procedures, and protocols.
Manage all scheduling and logistical components of hearings
Draft and communicate procedural decisions to parties.
Track SVSA hearing timelines for policy compliance.
At the conclusion of each hearing and in collaboration with the Appeal Officer, OPHD, Center for Student Conduct (CSC), the confidential survivor advocate, and the respondent services coordinator, convene and conduct post-hearing analysis to determine the need for systemic improvements and/or additional process/policy components. When process/policy improvements are identified as necessary, the hearing coordinator will implement them immediately.
Ensures compliance with relevant federal, state, and local laws and campus/University policies, while managing complex situations and safe-guarding timely caseload follow-up.
Manages logistics of the student conduct hearing process, such as scheduling of hearings and communications with hearing panel members, students, and advisors.
Exercises discretion to manage pre-hearing and hearing procedures, subject to specific procedural requirements set forth in the Code.
Provides analysis for highly complex projects dealing directly with major department managers.
Presides over and makes all procedural rulings at student conduct hearings.
Rules on procedural disputes that arise during the conduct process and fashions appropriate remedies for procedural violations including dismissal of charges, where appropriate.
Rules on requests for extensions of time.
Respond to data requests made by the media, auditors, investigators, campus affiliates, or members of the public made through the campus' Public Records Act process by compiling data and preparing reports, briefings, and executive summaries suitable for publication.
Establish and maintain contacts internally and with external constituents for the collection and exchange of data.
Develop assessment tool and conduct annual/ongoing assessment of CSC services, procedures, policies, and protocols. Use this data to prepare CSC's annual report and other executive briefings for Director, senior campus leadership, and faculty.
Participates on multi-disciplinary and campus-wide policy/planning committees and working groups related to relevant subjects such as SVSH, the Clery Act, etc.
Recruits staff and students to serve on student conduct panels; and, promotes the education of hearing panel members through skill development, constructive feedback, and improvement objectives. Promotes the leadership of the faculty chair and integrity of the hearing panel by recognizing their primary responsibilitydeciding on matters of policy violation(s) and recommending sanction(s) proportionate to the respondent's involvement
Resolves grievances that come to the Vice Chancellor's office for review and response.
Advanced level knowledge of the nature of conflict and conflict resolution and mediation techniques and exceptional critical thinking skills demonstrated by the ability to analyze information, evaluate results, and facilitate resolution of difficult challenges, including the ability to handle issues of complex and extreme political sensitivity and demonstrate balanced judgment and exceptional discretion.
Experience in problem identification and reasoning; ability to develop original ideas to solve problems; persuasion, leadership, and intercultural competence.
Outstanding communication skills demonstrated by the ability to interact comfortably with a wide range of diverse people, including professional staff, students, faculty, parents, system-wide colleagues, community partners, and media. This includes the ability to write clearly and concisely in different styles as appropriate to the audience.
Superior judgment, demonstrated by the ability to balance numerous demands, evaluate competing priorities, and adjust planning as needed.
Capacity to simultaneously engage multiple issues of very significant legal, policy and operational complexity with an unusually large and diverse number of constituencies.
Excellent organizational and structural skills including the ability to oversee a wide variety of activities, define problems, propose and implement effective solutions and prioritize competing priorities.
Strong counseling skills essential to mediate conflict, problem-solve, and respond appropriately to student concerns.

Thorough understanding of all applicable laws, rules, regulations, policies and procedures, research methods, techniques, and/or sources of information.
Advanced interpersonal communication skills to work effectively with a broad range of diverse populations within a complex and multi-layered organization, including effective listening, discernment, empathy and sensitivity skills.
Demonstrated ability to multi-task and work in a high stress work environment. Exercise impeccable judgment with when to inform and consult with senior University leaders on student conduct issues.

Independence and ability to gain confidence and respect of all relevant stakeholders.
Significant experience writing, interpreting and revising policies.
Ability to respond to various audiences accurately and calmly and make decisions under pressure and without immediate supervision; ability to maintain confidentiality.
Strong understanding of FERPA.
Experience collaborating with various upper administrators and campus stakeholders such as UCPD, General Council, Dean of Students, Title IX Coordinator, the University of California Office of President, Media Relations, and Chancellor's Office.
Knowledge and understanding of Title IX, the Clery Act, the on-going investigations conducted by the Office of Civil Rights into campus sexual misconduct, California's Public Records Act, and common campus-specific and UC system-wide policies.
Previous experience working with confidential records and sensitive documents
Bachelor's degree in related area and/or equivalent experience/training.
Master's degree in Higher Education Administration, Communication, Public Policy or a directly related field; strong writing, research, advocacy, negotiating and interpersonal skills. Experience with legal due process requirements and hearing procedures.
Five years of experience working with student discipline within a college or university setting.
