About the Job
Under the administrative direction of the Human Resources Director, the ELR Manager works in a highly collaborative manner and is responsible for administering human resource policies and procedures, recommending, developing, and implementing employee relations programs, interpreting labor contracts, providing counsel regarding employee and labor relations matters at all levels of the organization, including HR staff. Responsible for managing the campus performance management program, grievance and complaint resolution program, corrective action, negotiation preparation, and managing and oversight of large-scale programs and initiatives.
In collaboration with senior leadership, develops and implements Labor Relations objectives, bargaining strategies, serves on or oversees employees serving on system-wide or local bargaining teams, and facilitates ongoing communication with union representatives to maintain effective working relationships. Makes written recommendations to HR Director to change existing policies and procedures to enhance the effectiveness of the employee and labor relations unit and manages and oversees the implementation of recommendations. Exercises sound judgment within defined policy or procedures to determine appropriate action. Effectively interacts with HR Managers and professionals, Senior Leaders, Supervisors, and Managers across the organization. Establishes objectives and determines how to use employee and labor relations resources and best practices to meet schedules and goals. Provides effective leadership and guidance to subordinates to achieve goals in accordance with established policies and CBAs.
ELR Manager is responsible for exercising strong judgment in interpreting and administering labor contracts and applicable personnel and University policies. Manages the development and implementation of recommended changes to policies and procedures. Represents the campus on systemwide labor negotiations and acts as Chief Negotiator for local bargaining. Participates in Protest Oversight Committee and other campus and systemwide committees and workgroups. Responsible for influencing and formulating recommendations that have a significant effect on campus operations and that are legally enforceable. This is a critical position where erroneous decisions or failure to achieve goals and meet deadlines could result in additional costs to the institution.
KEY RESPONSIBILITIES:
1. As directed, represents UC Merced at systemwide bargaining; effectively collaborate and counsel with management (and others as appropriate) to identify campus goals and represent those objectives at the systemwide table. Works in a highly collaborative manner to build consensus with other campuses regarding labor relations objectives. Proactively communicates status of systemwide bargaining to campus leadership, ELR team, and collaborates with Compensation on wage proposals and costing to advocate for UC Merced's position. Informs and educates the campus community on compliance with systemwide agreements. Responsible for local bargaining with various systemwide and local bargaining units, develops effective bargaining strategies leading to desired business outcomes and within established management parameters, confers with senior management as needed, writes proposals/contract language, and is responsible to coordinate and manage the implementation of legally binding agreements. Facilitates group meetings using, diplomacy and negotiation skills to effectively communicate among parties. Provides ongoing guidance to managers and supervisors on meeting responsibilities as defined by the Collective Bargaining Agreements (CBA) and develops strategies for resolving employee relations issues. Formulates procedures for supervisors, in alignment with the University's vision, mission, core values, CBA's policies, procedures, as well as federal, state, and local laws.
2. Responsible for administering and interpreting collective bargaining agreements, personnel policies, and University policies. Manages and monitors grievance/PPSM70 complaint (including academics grievance), request for information, unfair labor practice, conflict resolution (formal and informal), performance management, and employee relations programs; adheres to established timelines. Implement and monitor the use of metrics to measure success, standards, customer service, and accountability. Advise management on settlement options and coordinate the process. Represent the campus in grievance and arbitration proceedings and may be called upon to represent the campus on other legal proceedings. Works with legal counsel and HR leadership to effectively resolve conflicts and matters of high risk. Assists other campus compliance units with complex investigations and multi-forum complaint and grievance matters, including Whistleblower, Internal Audit, Equal Opportunity, and Title IX.
3. Provides effective management oversight to assigned labor relations and employee relations staff by establishing priorities and delegating work assignments effectively, ensuring proper adherence to collective bargaining agreements, university policies, employee relations, and/or employee accommodation policies and procedures. Advises ELR staff on local labor coordination strategies such as joint union/management committees and other forums. Effectively manages assigned staff, including developing individuals, and providing cross-training and professional development opportunities.
4. Oversees the Performance Management Program. Counsels employees and supervisors regarding performance-related and conduct-related job issues. Reviews and edits draft disciplinary actions such as reprimands, suspensions, demotions, disciplinary reassignment, and terminations. Acts as an informal mediator between employees and supervisors, as needed. Recommends, develops, and presents training material related to employee and labor relations topics. Oversees development of action plans in response to staff engagement surveys. Researches, identifies, and interprets current and emerging employee relations issues, trends, and opportunities; develops and implements responsive University-wide programs, initiatives, and communications, in collaboration with Staff Assembly and other campus units, e.g., Ombuds, OPHD, as appropriate.
5. Conducts and manages fact-finding workplace investigations concerning matters related to potential violations of the law, organizational policy, non-compliance, unethical behavior, and misconduct. Documents investigative interviews and collect, protect, and retain pertinent information and evidence. Reviews, assesses, and interprets information and evidence gathered from investigations. Effectively manages simultaneous investigations to ensure matters are resolved timely and appropriately.
6. Works in a highly collaborative manner with people of diverse cultures, managers and human resource managers on employee and labor relations matters, employment law implications relating to individual and campus-wide issues or courses of action.
